First, we’ve just won an incredible victory in the Montana Supreme Court, which stunned the nation with a ruling that sets up the first direct challenge to Citizens United. Boldly defying the U.S. Supreme Court, the Montana court voted 5-2 to uphold Montana’s century-old Corrupt Practices Act, which bars corporate spending on elections.
Jeff Clements, Free Speech For People’s co-founder and general counsel, helped win this victory by filing a friend-of-the-court brief in support of upholding the Montana law on behalf of FSFP and a coalition of Montana businesses and national business networks.
The result is that the U.S. Supreme Court must now once again face the question of whether corporations may spend limitless sums of money to influence our elections. And, they’ll have to do it at a time when the issue has sparked public outrage in the streets everywhere, and when the effect of the Citizens United ruling is on vivid display as corporate-funded political attack ads flood our airwaves during this election season. The U.S. Supreme Court will have to reckon with the controversy it has created, and this can only help build our movement, no matter what they decide.
